The civil hearing for Bauer’s temporary restraining order will take place in L.A. County Superior Court on Monday and Tuesday, and is anticipated to last two to three days. Day 3 of that hearing, on the other hand, will not take place until August 19, a 16-day gap that may be impossible to close.

According to a domestic violence restraint order, Bauer has been accused of choking a woman until she lost consciousness on multiple occasions, punching her in several areas of her body, and leaving her with injuries that required hospitalization over the course of two sexual encounters earlier this year.

The temporary restraining order was issued ex parte, meaning without the involvement of the other party. Bauer’s camp has fiercely rejected the sexual assault accusations, calling their contacts “wholly consensual” and stating in a previous statement that Bauer “vehemently rejects her description of their two encounters.”

Bauer’s lawyers sought extra time to prepare a defense against witnesses and evidence they said they didn’t get until the night before the hearing, so the first hearing on whether the temporary restraining order would become permanent was postponed another six working days.

Bauer, as well as the lady, were both present at the hearing. Bauer’s legal team urged the court that he should not testify because of the current investigation, but the petitioner’s side said that he must testify anyway, even if he uses his Fifth Amendment right to refuse to answer questions. Both parties will call up to ten witnesses in total.

Bauer hasn’t played for the Dodgers since being put on the disabled list on July 2. Bauer’s bobblehead night has been canceled, and all of his memorabilia has been withdrawn from the team’s and online shops, since the Dodgers “did not believe it was acceptable” given the investigations. Under MLB’s domestic violence policy, the league may put players on a seven-day administrative leave on its own, but it must seek the MLBPA’s permission to extend it after that. According to a league source, the MLBPA has been helpful in doing so thus far.

Bauer, the National League Cy Young Award winner in 2020 as a member of the Cincinnati Reds, signed a three-year, $102 million deal with the Dodgers in February that included two opt-out provisions.
